Update on Gay and Lesbian Marriage Cases and Impact on Idaho Employers

(Update to the May 2014 article, “An Employment Law Update on Gay and Lesbian Rights”)
The United States Supreme Court will hear four cases that address state laws that ban same-sex marriage or recognition of a same-sex marriage performed in another state or jurisdictions that allow same-sex marriages. The specific issues that the Supreme Court will hear are: (1) does the Fourteenth Amendment require a state to license a marriage between two people of the same sex; and (2) does the Fourteenth Amendment require a state to recognize a marriage between people of the same sex when their marriage was lawfully licensed and performed out-of-state?
