CONSTRUCTION LITIGATION STRATEGIES:  POSITIONING FOR A PREJUDGMENT INTEREST AWARD

A Contractor’s dream project would run smoothly with no delays, and everyone would be paid in full for the work performed. However, what happens when a project goes awry and litigation ensues? If the court awards damages to the owner, does that mean the contractor gets nothing?  Not necessarily!  A recent Idaho Supreme Court case awarded a contractor prejudgment interest even though the court also awarded damages to the owner.  Tyler Anderson will discuss this recent Idaho decision and share a few litigation war stories of his own!
