Professional Profile
Dylan Lawrence’s practice specializes in the areas of water rights, environmental, natural resources, mining, and land use law. Mr. Lawrence has been named a “rising star” by Chambers USA in the areas of natural resources and environmental law.
His expertise and experience include:
· Representation of clients before the Idaho Department of Water Resources in applications for new water rights, transfers of existing rights, and other administrative proceedings.
· Representation of clients in the Snake River Basin Adjudication and the North Idaho Adjudications, including assistance with preparation of water right claims and objections, and litigation of contested subcases.
· Counseling various types of clients, from large industrial facilities to alternative energy projects, with compliance with the various state and federal environmental quality and natural resources laws, such as the Clean Air Act, the Clean Water Act, the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA or “Superfund”), the Safe Drinking Water Act, the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Toxic Substances Control Act (TSCA).
· Representation of clients involved in civil and administrative enforcement actions with the Idaho Department of Environmental Quality and the U.S. Environmental Protection Agency.
· Conducting environmental and water rights due diligence on behalf of lenders and purchasers of real estate, and counseling those clients on contractual and regulatory tools available to minimize risks and liabilities and allow the transaction to close.
· Assisting various types of clients, including mining companies and guest lodges, with obtaining permits and other entitlements from agencies such as the Idaho Department of Lands, the U.S. Forest Service, and the U.S. Bureau of Land Management.
· Representation of clients involved in disputes over easements and rights-of-way.
· Representation of clients involved in administrative appeals to district court and the Idaho Supreme Court.
