Professional Profile
Mr. Gardner is a trial lawyer and maintains a broad-based litigation practice in both state and federal courts defending various clients in jury trials and workers’ compensation hearings. Mr. Gardner has also worked with several local hospitals in handling claims under the Idaho Medical Indigency Act, general collection matters and other health-care related issues.
Mr. Gardner was recently recognized by DRI publication The Voice for successfully obtaining summary judgment for a general contractor in a road-construction liability matter. He has also been successful in trying various cases on behalf of a large retailer involving claims of premises liability. In addition, he received a defense verdict in a products liability case for the largest U.S. manufacturer of ladders. He has successfully mediated cases in Idaho and Utah pertaining to all areas of practice and has presided as an evaluator over claims brought under the Idaho Small Lawsuit Resolution Act.
Prior to joining the firm, Mr. Gardner completed a two-year clerkship with Sixth District Judges B. Lynn Winmill, now the Chief District Judge for the United States Court for the District of Idaho, and N. Randy Smith, now a United States Court of Appeals Judge for the Ninth Circuit. As a law clerk, he researched and drafted court opinions, advised the court on matters of law, prepared jury instructions, and attended several hearings and trials.
