The practice of Moffatt Thomas includes all aspects of Environmental Law. Its lawyers have been involved in a number of lawsuits and transactions involving a wide variety of federal and state statutes, including: the National Environmental Policy Act (NEPA); federal and state regulation of underground storage tanks (USTs); municipal zoning and land use planning regulations; the Endangered Species Act (ESA); the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA); the Resource Conservation and Recovery Act (RCRA); the Toxic Substances Control Act (TSCA); the Clean Water and Clean Air Acts (CWA and CAA); state laws, including the Idaho Hazardous Materials Transportation Act (HMTA); and the Idaho Environmental Protection and Health Act (EPHA). The Environmental & Natural Resources practice group focuses on providing timely legal services in the following areas:
- Litigating environmental insurance coverage disputes and/or defending environmental claims.
- Counseling clients regarding legislative and regulatory developments, including drafting legislation.
- Counseling clients regarding compliance with state or federal regulatory requirements.
- Negotiating with administrative agencies on behalf of clients to meet regulatory requirements.
- Counseling clients concerning the acquisition or disposition of property containing toxic substances, hazardous waste, or underground storage tanks.
- Preparing contractual provisions for the sale or transfer of assets involving toxic substances, hazardous waste, or underground storage tanks.
- Representing clients in litigation with third parties or governmental entities concerning alleged environmental law violations.
- Mining law permitting, closure, and compliance counseling.
